Supreme Court Deliberates on Rivers State Political Turmoil

The Supreme Court needs time to decide four important appeals that involve the political conflict in Rivers State which has developed between Governor Siminalayi Fubara and FCT Minister Nyesom Wike.

The Supreme Court made decisions to postpone judgment on four crucial appeals that pertain to the Rivers State political crisis. Governor Siminalayi Fubara engages in a public dispute with Federal Capital Territory Minister Nyesom Wike that produces this political upheaval.

The hearing concluded as Justice Musa Uwani Aba-Aji alongside four other judges from the Supreme Court declared that the court would subsequently announce the judgment dates through proper procedures. The appeals in question are:

  1. SC/CV/1174/2024: Rivers State House of Assembly and others vs. Rivers State Government and nine others.
  2. SC/CV/1175/2024: Rivers State House of Assembly and others vs. Rivers State Governor and nine others.
  3. SC/CV/1176/2024: Rivers State House of Assembly and others vs. Rivers State Government and nine others.
  4. SC/CV/1177/202: Rivers State House of Assembly and others vs. Rivers State Governor and nine others.

The appellants fight against Federal High Court in Abuja decisions that banned the Central Bank of Nigeria from advancing regular financial distributions to Rivers State Government authorities. The lower court declared all financial allocations received by Governor Fubara from January 2024 were against the constitution.

Federal High Court Justice Joyce Abdulmalik found that Governor Fubara presented the 2024 budget to a four-member Rivers State House of Assembly group in violation of constitutional guidelines. The court issued orders to prevent the CBN alongside the Accountant General of the Federation and both Zenith Bank and Access Bank from granting Governor Fubara any access to funds held in the Consolidated Revenue and Federation Account.

The court emphasized the illegality of the 2024 Appropriation Bill which Governor Fubara implemented because it lacked passage from a properly established House of Assembly and therefore violated the 1999 Constitution. The court introduced an injunction that barred both the Governor and State Accountant General from authorizing bank withdrawals from Rivers State funds until the state passes an approved budget.

Governor Fubara and his attorneys pursued an appeal against these judicial rulings which resulted in ongoing court discussions at the Supreme Court. These appeals will produce outcomes that significantly affect Rivers State’s governmental management and financial control framework.

The political situation in Rivers State has become a national issue that shows how state and federal systems in Nigeria must find their proper equilibrium. People who watch the Supreme Court process observe the upcoming judicial decisions which might establish key legal principles affecting Nigeria’s constitutional framework.
